3-HOUR CONTINUING EDUCATION
Agency, Ethics, Fair Housing, Risk Management, and Trust Funds
Agency This three-hour course in Agency includes, as the primary focus of the course, coverage of agency relationships in a modern brokerage practice, review of duties, required disclosures and confidences and required forms, including those specified under Civil Code Section 2295 et seq., as related to: in-house sales, cooperative sales, dual agency, and buyer’s brokerage. (Other agency topics of current interest that are related to the activities of California real estate licensees are included in this course.)
This course also discusses the legal relationship whereby a principal appoints an agent to act on his/her behalf. The student will learn: agents have broad or limited power; how agencies are created; full disclosure; fiduciary responsibility; due care and loyalty. Also covered in this course are implied power and express authority.
Ethics The Ethics course includes three hours of extensive coverage of ethical practices, and where appropriate by way of example, unethical conduct involving real estate licensees that could be considered a violation of one or more subsections of B&P Code Sections 10176 and/or 10177.
This course also covers the ethical standards of real estate professional organizations, institutes, societies, etc., as well as specialized areas of real estate practice, e.g., commercial, industrial, business opportunities, mortgage lending, etc., and appropriate court decisions and practical examples and/or case studies as related to real estate practice and ethical behavior.
Laws set the minimum standard of acceptable human behavior. Ethics go far beyond the law and determine not if an action is legal, but whether it is right or just. Ethics, in fact, precede the law. Actions that formerly were legal but unethical are not often illegal. Court decisions have been applying the precepts of ethics to activities of real estate and determining that legal duties exist where no duties formerly were recognized.
Fair Housing The Fair Housing three-hour course should provide real estate licensees with: knowledge of Federal and State fair housing laws relating to the sale and rental of real estate; knowledge of selected Federal and State civil rights and anti-discrimination laws relating to real property transactions and business establishments; the ability to avoid practices that could be considered discriminatory in commercial and residential transactions and facilities; an understanding of the Voluntary Affirmative Marketing Agreement (VAMA) and its application in the real estate industry; and the desire to commit to affirmative compliance with the fair housing laws.
The main emphasis of this course will be on covering the Federal and State fair housing laws relating to the sale and rental of real property. By covering these laws, subtopics such as redlining, advertising, refusing to show property, blockbusting, etc., will be addressed.
This course covers the laws concerning discrimination such as California Fair Housing Laws, Fair Employment and Housing Act, Unruh Civil Rights Act, California Business and Professions Code, California Real Estate Commissioners Regulations, Americans with Disabilities Act, and any laws, statutes, or regulations related to fair housing.
Risk Management The three-hour Risk Management course should provide the student with knowledge of the principles, practices, and procedures calculated to avoid errors and omissions in the practice of real estate licensed activities, and the ability to recognize and resolve issues, and appropriately handle situations that most frequently result in litigation.
Risk Management can be applied to a wide range of functions and activities including negligence, negligent misrepresentation, intentional misrepresentation, fraud, constructive fraud, breach of fiduciary duty, breach of contract, violation of Business and Professions Code Section 17200 et seq., breach of duties pursuant to Civil Code Sections 1102 and 2079, etc.
Trust Funds The Trust Funds three-hour course provides the student with knowledge of the legal requirements for receiving and handling trust funds in real estate transactions, as set forth in the Legal Aspects of Real Estate and the Regulations of the Real Estate Commissioner. The course describes the requisites for maintaining a trust fund account. Further, the course explains and illustrates trust fund record keeping requirements.
Topics included in the course are: trust funds vs. non-trust funds; trust fund handling requirements; identifying the owner(s) of the funds; advance fee trust funds; trust fund bank accounts; accounting records; reconciliation of accounting records; documentation requirements; audits and examinations; consequences of trust fund conversion; and sample transactions to explain use of records
REGISTRATION AND TUITION FEES The school charges a nonrefundable registration fee of $00.00 in the event of cancellation after three (3) days.
COSTS FOR HOME STUDY AND ONLINE PRESENTATIONS The tuition for each 3-hour continuing education course is $39.00; any and all instructional materials, books, handouts, etc. are furnished at no charge.

This course is offered via home study and online presentation. There is no attendance required in the home study or online course. The student reads the textbook; answers quiz questions in either home study or online format, and must pass the final examination either under the home study guidelines or online guidelines. The student does not need to pass the quizzes with a particular score. However, any Continuing Education final examination segment requires the student pass with a minimum score of 70% or higher. Students may not take nor pass any final examination segment for more than 15 hours of credit in a 24 hour period. In other words, students can complete and pass a final examination segment for 15 hours of credit or less in a 24 hour period. In the event the student does not pass any final examination segment, the entire course must be retaken.
Under home study guidelines, final examination segments may not be furnished directly to the student. Final examination segments must be submitted under sealed envelopes to a qualified Test Administrator whom Executive Programs has chosen. When participating in a home study program, a student must provide the Test Administrator/Monitor with a current form of identification acceptable by the Department of Real Estate. A 45-hour Continuing Education course may be completed in as little as eight (8) calendar days. However, final examination segments must be separated and completed in 15 hour intervals with 24 hours between each. In other words, a 45 hour Continuing Education course would require 3 separate 15 hour final examination segments separated and completed over 3 whole calendar days. Students must complete all quizzes and final examination segments to receive a Certificate of Completion for any and all parts. The student must complete the full program within the contract enrollment period or the course will expire and no credit will be given. Continuation will require re-enrollment and payment of additional fees. Enrollees are advised and cautioned that this educational institution maintains student records for a five (5) year period only.
Students may request a convenient time and date for the final examination segment and may also suggest the Proctor or entity to administer the final examination segment. However, final designation and approval of the final exam Test Administrator and determination of the time and date is the Sponsor’s responsibility. The Test Administrator cannot be related by blood, marriage, domestic partnership, or any other relationship to the student taking the exam which would influence them from properly administering the examination segment. If a Test Administrator will be used, the Sponsor must send the examination segment materials directly to the Proctor and the Proctor must return the materials directly to the Sponsor. Under no circumstances may the final examination segment be furnished directly to the students. The Sponsor is required to take steps to protect the integrity of the exam and to prevent cheating in an examination.
Under online guidelines, a three (3) hour Continuing Education course must be completed with a score of 70% or higher to receive credit for the course. The student may complete a 45 hour Continuing Education course in no less than eight (8) calendar days. In addition, a student cannot complete more than a 15 hour final examination segment in one (1) 24 hour period. The student must complete the course within the contract enrollment period or the entire course will expire. Continuation will require re-enrollment and payment of additional fees. Enrollees are cautioned that this educational institution maintains student records for a five (5) year period only.
The students are assisted by live counselors. The final examination segment will be enabled once the minimum state required time frame has been satisfied. Students are required to log in, using unique username and password. The final examination segment is not printable and will automatically time out after the mandated time limit.
The final examination segment is neither printable nor downloadable. The final examination segment will “time-out” after the allotted time has expired; the student is not allowed to continue working on the final examination segment after the expiration of the allotted time. The time to complete the final examination segment starts when the student first accesses the online final examination segment. The final examination segment offered online is the same as the final examination segment approved by the DRE for the traditional correspondence courses using and Test Administrator. The only material that student can use to complete an open-book final examination segment is the course materials that have been approved by DRE for that particular course. Executive Programs cannot provide assistance to the student during the administration of the final examination segment; each student must complete the final examination segment by himself/herself. Executive Programs will instruct the student that they are required to spend the requisite number of study hours and of the DRE approved course material before taking the final examination segment, i.e., a 45 hour course requires 45 hours of study time; a 15 hour course requires a 15 hours of study time; a 3 hour course requires 3 hours of study time.
When the student completes their course requirements and prior to sending the Certificate of Completion for Continuing Education Courses, an Executive Programs counselor will review their full file to be certain all DRE rules and regulations were followed.

This course is exempt from Article 2.5. Since the school offers courses through home study and online method, it can only provide passage rates for this course, not for the state examination.
Executive Programs has provision for cancellation and refund or transfer of registration. You may transfer fees to any other program offered by the school and/or transfer fees to another student at no additional charge.
Buyer’s Right to Cancel You have until midnight of the eighth business day from the date of enrollment to cancel any and all agreements and charges, less the $00.00 registration fee. Cancellation must be made in person or by certified letter, telegram, or fax. Postmark determines the time period. Cancellations will not be accepted on the ninth business day after enrollment.
Refund Policy You may cancel enrollment within eight (8) business days from the date of enrollment and receive a full refund of all monies paid, except the $00.00 registration fee, provided no lessons have been completed, materials used, or seminars attended.
Refund for Materials To get refund for the course materials, you must return all instructional material. The following conditions must apply: (1) the materials have not been damaged or used; (2) the materials must be current; and (3) you prepay the return shipment. Refund will be promptly processed within 45 days of compliance with the preceding conditions.

CONTINUING EDUCATION
- A minimum of eight (8) calendar days from receipt of material is required to receive 45 hours of continuing education credit.
- No more than a 15 hour final examination for Continuing Education may be completed in a 24 hour period.
- A minimum of three (3) calendar days from date of enrollment is required to receive fifteen (15) hours of continuing education.
- When participating in a home study program, a student must provide the Test Administrator/Monitor with a current form of identification acceptable by the Department of Real Estate.
- A maximum of two (2) computers maybe used during a single enrollment period. If additional computers are detected, the user account will be deactivated and must be reset by Executive Programs Staff.
- A DRE approved textbook is required reading/reference material for the course.
- The student must pass final examinations with a score of 70%.
- The course will expire one (1) year from the student’s date of enrollment.
- The student has eight (8) calendar days from date of enrollment to cancel the enrollment and receive a full refund.
- Tuition must be paid in full for all programs, courses, or products ordered before any Certificate of Professional Achievement will be issued for any course.
